Mortgages negative a legal analysis

The euribor was slightly negative. The ECB’s decision Thursday to place the official interest of money at 0% portends that the Euribor may remain negative in the coming months.

This unexpected situation makes some mortgages and small differential sateen negative. If we consider also the negative inflation, we face negative real rates:  we paid for mortgaging.

Obviously this scenario does not seem very reasonable so some banks have rushed to put clauses zero interest floor. But given that the Supreme Court has considered null the clauses floor, some consider that such clauses would be null zero interest.

That said, the worst is that in a scenario of rates to 0%, still remain tens of thousands of mortgage contracts with clauses ground force. Entities such as the People have unilaterally decided to remove that clause 101,000 contracts. A wise decision that eliminates the expected litigation following the judgment of the Supreme avoiding costs and inconvenience to the user and the entity.
